General Provisions and Definitions for Northern Proxy Services

Introduction to Northern Proxy

Northern Proxy is a legal entity based in Vancouver, BC Canada, specializing in providing state-of-the-art 4G and 5G Mobile Proxy Connection services (“Services”). Individuals or entities utilizing Northern Proxy’s services are regarded as clients under this Agreement (“Client” / “You”). Northern Proxy offers a variety of mobile proxy solutions accessible through our website, pinnacleproxy.com (“System”). Utilizing our System and Services signifies your acceptance of this Agreement, our Privacy Policy, our KYC Policy, and Acceptable Use Policy. This Agreement becomes effective upon account creation within the System, as detailed in Clause 2. For any inquiries, please contact us at support@northernproxy.com. We reserve the right to amend this Agreement at any time, with continued use of our Services indicating acceptance of the revised terms. Consent to this Agreement includes approval for processing personal data as necessary for Agreement execution. Disagreement with any terms requires the immediate discontinuation of System use.

Account Creation

Registering requires submission of personal and, if applicable, company information. System use implies agreement with our cookie policy, outlined in our Privacy Policy. Creating an account necessitates acceptance of this Agreement and our Privacy Policy. Clients may undergo identity verification as part of our Privacy & KYC Policy. All provided information must be accurate, complete, and regularly updated. Accounts are intended solely for the use of the registered Client, whether for personal or business purposes. For enhanced security, two-factor authentication (2FA) is recommended.

Suspension and Account Access Removal

Northern Proxy may suspend Services or remove account access for reasons such as information discrepancies or breaches of this Agreement. Grounds for service denial or suspension include failing to meet legal age requirements, using the services from restricted locations, breaching our Acceptable Use Policy, and posing risks to our security or reputation. Suspensions will be communicated in writing, including the reasons and, if applicable, rectification steps.

License for System Use

Clients are granted a limited, revocable license to access and use the System and Services in line with this Agreement. The System and Services must be used lawfully and ethically. Northern Proxy owns all intellectual property rights in the System. Misuse of the System’s intellectual property is prohibited.

Acknowledgment of Risks

Clients acknowledge the risks involved in using the System and Services, such as software vulnerabilities, regulatory changes, theft, internet security flaws, and tax implications. Northern Proxy is not liable for losses due to spoofing, phishing, or similar attacks.

Payments and Refunds

Services may be offered on a fee basis or for free (e.g., trial). Fees are subject to change; Clients should verify current pricing before ordering. Fees for subscriptions and continuous services are generally non-refundable, except in cases of service inactivity or defects identified within the first 24 hours after purchase. Clients are responsible for all applicable taxes and ensuring payment information is accurate.

Third-Party Services and Disclaimers

Use of third-party services is at the Client’s discretion and subject to those services’ terms. Northern Proxy does not guarantee the accuracy of third-party website information linked within the System.

Indemnification

Clients agree to indemnify Northern Proxy, its parent company, affiliates, directors, officers, employees, agents, successors, and assigns from any claims or liabilities arising from their use of the Services or violation of this Agreement. Northern Proxy will notify Clients of any indemnifiable third-party claims, with Clients assuming defense and settlement responsibilities. Northern Proxy may participate in the defense at its own expense. Clients accept responsibility for their actions while using the Services and any resulting harm or damage. Indemnity obligations do not apply to damages caused by Northern Proxy’s negligence or misconduct. These indemnity obligations survive the termination or expiration of this Agreement and the use of the Services.

Agreement Termination

Northern Proxy may terminate or suspend Accounts and Services in accordance with this Agreement. Termination does not affect the obligation to pay for Services rendered. Material breaches may result in a permanent ban from the Services.

Governing Law and Compliance

This Agreement is governed by the laws of Canada, specifically the province of British Columbia. Service use must comply with anti-corruption, anti-money laundering, and international trade laws.
